Please read the following terms and conditions of use (the “Terms of Use”,or the “Agreement”) carefully before accessing or using the Site or mobile App. This Agreement in conjunction with the Privacy Policy and other terms andconditions/policies which may be posted on theSite or on the App, constitute a legal agreement that governs your use of the Site andthe App. By using the Platforms you agree to be legally bound by these Terms of Use. You are only authorized to use the Platforms if you agree to abide b y all applicable laws to this Agreement. If you do not agree with the terms and conditions set forth herein, please exit the Platforms and do not use the Site or the App furthermore.
1. Definitions
“Health Professional(s)” refers to any professional caregiver who registered to the Platform as such and is licensed under applicable law and regulation to provide health services to the public; “Media” means any text, video, photo and/or PDF files uploaded to User’s account. “SOSVC” shall refer to the online websites www.m4life.co and www.sosvc.com and www.sos-orthopedist.com and the mobile App also known as the SOSVC App, owned and administrated by the Company for professional use, downloadable on “Google Play Store” and on “Apple App Store” (the “Site” and “App” respectively, and jointly the “Platforms”).
“Patients” means any person registered to the Platforms as such and who is not a Health Professional (as defined above).
“Services” or “Use” means all services made available by the Platforms, including but not limited to, services accessed through the App or the Site and medical or paramedical advices provided by Health Professionals to Patients through the Platforms.
“User” means any person or entity registered to the Platforms (either Patients or Health Professionals, as defined below);
“User Content” means any and all communications, materials, information, data, opinions, photos, profiles, messages, notes, website links, text information, music, videos, designs, graphics and any other content that User may post or disclose via the Platforms;
2. General
These Terms of Use, as may be amended from time to time, apply to any Use and/or Service provided through any mobile device, via email, or by cell phones. Please note that the Company is entitled to amend these Terms of Use from time to time. If you do not accept such amendments, you must notify the Company, via the Platforms, in writing within 10 days following the date on which you have been informed of the applicable amendments. If you do not notify the Company timely of your non-acceptance, you will be unconditionally bound by the amended Terms of Use for all intents and purposes.
Please read these Terms of Use carefully as by giving your consent to these Terms of Use together with the Privacy Policy, you acknowledge, approve and confirm that you have read and understood these Terms of Use together with the Privacy Policy, and you accept and agree without limitation or qualification to be bound by both of them.
3. The Services
SOSVC is a Platform for simplified and secure communications by and between Patients and Health Professionals for purposes of medical and paramedical information & education during clinics and cares, professional brainstorming or advancement of research.Users may use the Platform for secured record keeping and archiving of their private medical information uploaded as User Content to the Platforms.
4. Eligibility
To be eligible to use the Platforms, you must be at least 18 years old. Otherwise, the registration to the Platforms is accessible solely upon receipt of a parental or legal guardian consent to be delivered to the platforms in writing.
If you have not provided your explicit consent to be bound by these Terms of Use, such consent may be inferred from your use of the Platforms, for all intents and purposes.By using this, you represent and warrant that you have the right, authority, and capacity to enter into these Terms of Use and to abide by all of the terms and conditions set forth herein. If you do not accept these Terms of Use unconditionally in full, please do not install, use or access the App or utilize any of the Services and immediately (i) delete the App should you have already installed it; and/or (ii) stop using the Site.
5. Use of Services; License
The use of the Services is not and shall not be deemed as a sale, transfer or assignment of any rights in or to the Platforms. You are hereby granted a personal, non-exclusive, limited, revocable license to install and use the App and the Services as provided by the Company, subject to the provisions of these Terms of Use (the “License”). The rights granted herein are subject to your continuous compliance with the provisions of these Terms of Use. Without prejudice to any other rights and remedies the Company may have hereunder, any non-compliance, which shall be determined at the Company’s sole discretion, entitles the Company to deny you further use of the Services. All rights not expressly granted to you herein are reserved by the Company. The Company retains all rights, titles and interest in and to the Platforms and the Services, including, but not limited to, all copyrights, trademarks, trade secrets, trade names, proprietary rights, patents, titles, computer codes, audiovisual effects, themes, characters, character names, stories, dialog, settings, artwork, sound effects, musical works, and moral rights whether registered or not and all applications thereof. Unless expressly authorized by mandatory applicable legislation, or by consent of the Company (in accordance with applicable law) you will not, without the Company’s prior written consent:
(i) commercially exploit the Platforms other than using it as it intended, under these Terms of Use;
(ii) distribute, lease, sub-lease, license, sell, resell, rent, lend, convey or otherwise transfer, dispose or assign the Platforms or the Services, any copies thereof, or any passwords or usernames associated with the Platforms or the Services,
(iii) copy, reproduce or distribute the Platforms in any manner or medium, in whole or in part, or decompile, disassemble, or reverse engineer the Platforms by any means whatsoever;
(iv) cause the Platforms to be publicly available or available on a network for use or download by users not otherwise registered to the Platforms in accordance with the provisions hereof;
(v) use or install the Platforms (or permit others to do the same) on a network, for on-line use,
(vi) remove, alter, or obscure any product identification, copyright, intellectual property, author attributions, legal notices or other labels of the origin or source in the Platforms,
(vii) alter, modify, enhance, or create a derivative work of the Platforms.
6. Registration Process
During the registration process, your personal information will be collected and saved on SOSVC’s servers under the provision of the Israeli Protection of Privacy Law, 5741-1981 (the “Law”). By registering as one of the Users, you certify that the information you provide on the registration form is accurate and pertains only to you. You are and shall remain solely responsible for maintaining the confidentiality of the password and other user credentials you have chosen during the registration process to M4Life. Please refrain from sharing your password with any other person. The Company reserves the right to deactivate or suspend your account and/or your ability to make use of the Services for any reason, at his sole and absolute discretion. Your user account will be classified either as a Patient account or a Health Professional account. Such classification shall be selected by you during the registration process and based on your intended use of the Services. As part of the registration process you will be asked to provide certain personal details such as your full name, ID number, address, phone number, gender, date of birth, media and documentation you wish to associate with your user account and additional information the Platforms may request that you provide. Please note that as a Health Professional additional documentation will be required in order to authenticate your license to provide professional medical or paramedical services. Please note that SOSVC may, at its sole discretion reject or deny your registration to the Platforms if it deems that such registration is associated with fraudulent activity, competitive activity or for any other reason the Company finds, in good faith, as malicious or offending.
7. Use of your Information
SOSVC will make use of the User Content you upload to the Platforms in accordance with the provisions hereof and the provisions of the Privacy Policy [https://m4life.co/m4life-privacy-policy/].User Content may be shared with other Users (either Patients or Health Professionals) at the respective User’s sole discretion. SOSVC will not share your User Content with any other User without receiving your explicit request or consent to do so. By sharing your User Content with another User you give your consent to such User to:
a) access your uploaded Media and User Content; and
b)transfer your User Content to other Health Professionals (provided the User is a Health Professional) for consultation and/or second opinion and/or research purposes.Please note that any use by a Health Professional of any User Content for research purposes is subject to such Health Professional receiving the respective User’s prior explicit consent.
ANY RESEARCH PERFORMED BASED ON USER CONTENT IS NOT PART OF SOSVC’S SERVICES, AND IF PERFORMED, IS AT THE HEALTHCARE PROFESSIONAL’S SOLE RISK AND RESPONSIBILITY, ACCORDING TO ANY APPLICABLE LAWS, REGULATIONS AND ETHICAL STANDARDS.
8. No Unlawful or Prohibited Use
You may not use this Platform for any purpose that is unlawful or prohibited by applicable law or by the Terms of Use provided herein, or interfere with any other User’s use of the Platforms. You may not attempt to gain unauthorized access to the Platforms or any part thereof, or the computer systems or networks connected to any of SOSVC’s servers through any means. You may not obtain any materials or information through any means not intentionally made available to you through the Platforms.
9. Fees and Costs
Unless using premium professional account, the Services as offered by the Platforms are free of charge.
10.Term and Termination
Unless set out otherwise by SOSVC, the term of your License shall commence on the date that you start to download, install or otherwise use the Platforms, and shall lapse on the earlier of: (i) the date that the term set by SOSVC terminates; or (ii) the date that delete the App or stop using the Site, or (iii) your attempt to circumvent any technical protection measures used in connection with the Platforms, or (iv) your use of the Platforms is in breach of these Terms of Use, or (v) SOSVC decides to terminate your engagement with the Platforms and to revoke any and all rights previously granted to you in connection with the License.
Without limiting SOSVC’s statutory rights to terminate or SOSVC’s other rights and remedies, SOSVC is authorized to suspend the fulfilment of the obligations or to dissolve the License with you without incurring any liability for compensation in the event:
a) That You fail to fulfil your obligations to SOSVC, whether partly or in full;
b) Company discovers that you do not use the Plaforms in accordance with these Terms of Use;
c) Company receives complaints in respect of your use of the Platforms;
d) Company becomes aware of circumstances that constitute valid grounds to expect that you will not timely fulfil your obligations; Under no circumstances Company shall become liable in any way if false complaints or wrong judgment of your behavior, leads to suspension of your use of the Platforms. Promptly upon termination, you must cease all use of the Platforms and remove and destroy all copies of the Platforms in your possession or control.Please be advised that at any point you are entitled to either delete all or part of your User Content or to cancel your user account with SOSVC, which will automatically (entirely) delete your uploaded User Content. Furthermore, if you desire to stop sharing your Media or User Content with a specific User, you are entitled to revoke and previous access rights granted to such User at any time.Not withstanding the above, SOSVC will retain copies of your User Content where it has an overriding legal interest which requires it to preserve such copies, for example for the purpose of legal disputes or in order to comply with any order or writ issued by a competent court or governmental authority. Any reservation of User Content will be subject to SOSVC’s Privacy Policy.
11.Disclaimer; Liability; Indemnification
Your use of the Platforms is at your own account and risk. You are responsible for any and all use of the Platforms, as well as for the integrity of the password and other identifying means in respect of your User Account. Please keep your username and password secure and not allow anyone else to use your login credentials to access the Platforms.SOSVC is neither responsible nor liable for any loss that results from the unauthorized use, with or without your knowledge, of your username, password and/or other identifying means.The Platforms are currently designed for the Israeli market. It should not be used outside of the State of Israel. Any use of SOSVC’s Platforms outside of Israel is done at the User’s sole risk, liability and discretion.
You agree and warrant that your use of the Platforms, and your User Content, will not infringe upon any and all rights of third parties, including but not limited to intellectual property rights, moral rights and privacy rights and, more specifically, that such use will always be in conformity with all applicable laws and regulations and with the professional standards in respect of data protection and confidentiality. You hereby agree to defend, indemnify and hold harmless the Company and its shareholders, directors, office holders, employees, service providers and any of his affiliates, from and against all damages, claims, costs, charges and expenses (including attorneys’ fees) arising out of your use of the Platforms
You must notify the Company immediately in the event you become aware of any access to or usage of the Platforms or of User Content by third parties under your Account that you did not authorize, or any other possible breach in security. SOSVC cannot guarantee that the Platforms and the Services will always be available or will always workwithout any interruptions, errors or defects, or that the information provided on the Platforms is complete, correct, accurate and/or up-to-date. The Platforms and the Services are provided to you ‘as is’ and may include defects. They are provided without warranty of any kind, without performance assurances or guarantees of any kind, and your use is at your sole risk. SOSVC do not make, and disclaim, any and all express or implied warranties, including implied warranties of condition, error-free or uninterrupted use, accuracy of data, merchantability, compatibility, interoperability, satisfactory quality, fitness for a particular purpose, non-infringement of third party rights or that any errors ordefects in the Platforms and/or the Services will be corrected. The Company at all times has the right, but can never be obliged, to update, to upgrade and/or to adapt thePlatforms and/or the Services and/or to change or remove data or information stored on the Platforms.
YOUR USE OF THE PLATFORMS IS AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAWS, NEITHER SOSVC, NOR ANY OF ITS SUBSIDIARIES, AFFILIATES, SUPPLIERS, EMPLOYEES, OFFICERS OR DIRECTORS, NOR ANY OF ITS AGENTS OR ANY OTHER PARTY INVOLVED IN DEVELOPING THE PLATFORMS, THE CONTENT PROVIDED THEREBY AND THE SERVICES, ARE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE (A) OR THE INABILITY TO USE OF THE PLATFORMS, (B) OF THE SERVICES PROVIDED THORUGH THE PLATFORMS, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF ANY SUCHDAMAGES. THIS INCLUDES BUT IS NOT LIMITED TO THE LOSS OF DATA OR LOSS OF PROFIT, EVEN IF IT WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Confidentiality
Health Professionals shall keep confidential any and all medical information and or Media which they receive access to when a Patient connects his/her account with such Healthcare Professional’s account. The Healthcare Professional shall only be allowed to make use and access a Patient’s User Content for so long as the applicable User grants such Health Professional the right to do so and such grant of rights has not been revoked by the applicable User. The Patient may, at any time, disconnect his/her account from the Healthcare Professional’s account, thereupon there will be no further access to said Patient User Content by said Health Professional. Notwithstanding the aforesaid, any notes, copies and/or derivative information produced from such User Content may only be used by a Healthcare Professional for overriding legal obligations (such as legal disputes,abiding a court order etc.)
13. Data Protection and Privacy
SOSVC highly regards your rights in your personal data and your privacy. SOSVC’s collection and use of your data is subject to its Privacy Policy and is performed according to all applicable laws and regulations.
14. Revisions to the Terms of Use
As aforementioned, the Company may at any time, and without notice, revise these Terms of Use by updating them on the Site and on the App. By accepting these Terms of Use you are bound by any such revisions. It is recommended that you periodically visit this page to review the current Terms of Use.
15. Survival and severability
Any provisions in these Terms of Use, which by their nature extend beyond the termination or expiration of any license under these Terms of Use, will remain in effect after such termination.If any provision of these Terms of Use is deemed to be void, invalid, unenforceable or illegal, the other provisions shall continue in full force and effect. In case of any such invalid provisions, SOSVC will replace such invalid provisions.
16. Law and Jurisdiction
These Terms of Use and your use of the Platforms are governed by the laws of the State of Israel. The courts of competent jurisdiction located within the District of Tel-Aviv, Israel, will have the exclusive jurisdiction over any and all disputes arising out of, relating to or concerning these Terms of Use and/or the Platforms or in which these Terms of Use and/or the Platforms are a material fact.
17. User Complaints and Questions
You hereby agree to bring any and all complaints regarding the Services to the Company as soon as possible in order to provide SOSVC with the opportunity to address such complaint properly and to resolve any outstanding issues. SOSVC assumes no liability for complaints that are not properly brought to the attention of the Company with sufficient notice for it to resolve or attempt to resolve any of your complaints. SOSVC may, upon receiving a request at support@m4life.care, produce and provide you with a transcript ofthe User Content transfers performed from your account to other User accounts, within a reasonable period after submission of such request. All requests addressed to SOSVC should have the User’s account name in the subject. Any and all questions addressed to SOSVC may be sent to the following e-mail address: support@m4life.care. The Company will do his best to respond to any and all inquiries timely and diligently.

This Privacy Policy covers the treatment of the information gathered by the company (“SOSVC”) when you (the “User”) are using or accessing the websites “www.M4Life.co” – “www.sosvc.com” – “www.sos-orthopedist.com” or by using the mobile App (the “Site” and “App” respectively and jointly the “Platforms”) or any services accessed through the Site as may be provided by SOSVC (the “Services”).
This Privacy Policy does not apply to the practices of other businesses that SOSVC does not own or control, including other companies’ websites, services and applications (“Third Party Services”) that you can access through the Platforms.
SOSVC may amend this Privacy Policy from time to time. The use of information collected by SOSVC is subject to the Privacy Policy in effect at the time such information is used, however, SOSVC shall update you and prompt you to agree when any change introduced to this Privacy Policy which may affect your rights in the Personal Information (as defined below) and you agree to be bound by any changes to the Privacy Policy when you use the Services after those changes become effective.
2. Collection and Usage of Personal Information
2.1. SOSVC collects the following types of your personal information, when:
2.1.1. Registration to the Platform – When you register and create a user name, SOSVC will collect:
2.1.1.1. User which is a Patient – Your name, your e-mail address, the sick fund you are subscribed to, your ID number, your cell phone, your birthdate;
2.1.1.2. User which is a Health Professional (Caregiver) – you name, your e-mail address, the name of your clinic/healthcare institute, your license number,your cell phone number; your ID photography
2.1.2. When a Patient upload Medical Information and documents: When you upload scanned copies and/or pictures and video clips to the SOSVC interface, the content thereof is collected and saved onto SOSVC’s servers;
2.1.3. When a Health Professional shares Patient Information: When you access uploaded patient medical information and select which healthcare professional you wish to share the patient’s medical information with, SOSVC will create a record containing the details of the users involved, the time of transfer, and the purpose of the transfer to the recipient healthcare professional.
2.2. SOSVC will use the personal information collected as stated in article 2.1 above, as follows:
2.2.1. To grant access, following the receipt of your approval, to those health professionals whom you wish to share your information with;
2.2.2. To send your notifications and updates on receipt of feedback from health professionals, on changes to SOSVC’s terms of use and this Privacy Policy, and onnew features introduced to the SOSVC platforms;
2.3. SOSVC undertakes that if it shall need to make use of service providers or third-parties in order to process your personal information as part of the Platforms and/or Services, then it will bind all such third parties and/or service providers with provisions which shall sufficiently ensure protection of your personal information, as stipulated by law.
2.4. All information disclosed to SOSVC regarding the usage of the Platforms and/or the provision of Services, shall be kept by SOSVC as confidential and SOSVC maintains strict physical, electronic, and administrative safeguards to protect your confidential information from unauthorized or inappropriate access.
2.5. All medical information uploaded by users which have a patient account, shall be maintained and saved on SOSVC’s servers, in Israel, for a duration of five years, unless at an earlier date the user instructs SOSVC to delete any or all medical information from his/her account and/or upon unsubscribing to the SOSVC Platform.
2.6. Be advised that SOSVC is not responsible for the confidentiality and/or privacy protection of any medical information through the medium by which it was photographed, recorded or scanned, and the user is responsible to protect his/her medical information on the mobile device or personal computer which was used to capture and upload such medical information, including the responsibility to remove any copies of such medical information from any electronic drive, cloud services or PC/mobile device’s memory. It is strongly advised to not upload medical information through unprotected or public internet networks, or via any public or third-party owned devices.
3. COMPELED DISCLOSURE
SOSVC reserves the right to access, read, preserve, and disclose any information that it reasonably believes is necessary to:
3.1. satisfy any applicable law, regulation, legal process or governmental order;
3.2. enforce this Privacy Policy, including investigation of potential violations hereof;
3.3. detect, prevent, or otherwise address fraud, security or technical issues;
3.4. respond to user support requests, or
3.5. protect the rights, property or safety of SOSVC, its customers and the public. This includes exchanging information with other companies and organizations for fraud protection and spam/malware prevention.

SOSVC uses IP addresses to analyze trends, administer the site, track users’ movements, and gather broad demographic information for aggregate use. IP addresses are not linked to Personally Identifiable Information. SOSVC doesn’t use and doesn’t store cookies or any other tracking technology on your device
5. INFORMATION SECURITY
SOSVC endeavors to protect the information it collects about its users using industry-standard security processes and controls, however, despite these efforts, (i) no computer system is immune from intrusion; and (ii) information transmitted to the Site may need to pass through many systems in order to process such information. Therefore, SOSVC does not guarantee or warrant that the measures that are taken to protect the collected information will prevent unauthorized access to the information about you that is stored by SOSVC. In the event SOSVC experiences a breach of security, you will promptly be notified if your personal information has been compromised, in accordance with applicable law.

7. REGULATORY COMPLIANCE
SOSVC understands the sensitivity of collecting and using health-related data. Personally identifiable health-related data collected on the Platforms will not be shared in any manner which is not specifically set out in this Privacy Policy or the Terms of Use. SOSVC will comply with all guidelines, policies and regulations set forth by the Israeli Ministry of Health regarding the collection and use of health-related data, and with all laws, regulations and guidelines regarding privacy protection, including but not limited to the Israeli Privacy Protection Law, 1984 and the Israeli Privacy Protection (Data Protection) Regulations, 2017.
8. REGISTRATION OF MINORS TO THE SERVICES/PLATFORM
SOSVC respects the privacy of minors under the age of 18, and any such minor shall, upon parental or legal guardian application, may be registered to the Service.
Further to the foregoing, no minor shall be permitted to register to the Platform independently unless such minor alongside the submission of a consent form in the form available at: support@m4life.care.
Any child under the age of 18 may not submit any personal information through the Platforms until he/she has received confirmation from SOSVC that the required parental consent form has been submitted and approved. If you are a parent or legal guardian that no longer wish your child to make use of the Platforms,then please send SOSVC an e-mail to: support@m4life.care, and upon proper identification, parents or legal guardians may review the personal information collected about their child, request deletion, or refuse to allow further collection or use of the information.
